Many people have heard that New York is a No-Fault State and interpret that to mean that it does not matter whose fault the accident was in seeking recovery. However, this is only partially true. Regardless of fault you are entitled to recover for medical expenses, lost wages up to $2000 a month and some minimal additional expenses. However fault is required to be shown against the other driver to recover for pain and suffering. In addiiton, fault will still determine who receives a ticket, who pays the property damage and whose insurance premiums will increase.
