      <title>Medical Malpractice More Truths</title>
      <description>&lt;p&gt;The facts about medical malpractice need to be told. Most of the information that people believe are myths generated by the health care industry. The facts are astounding.  Currently, attorneys and patients have no way of knowing who these bad doctors are because the National Practitioner Data Base's public use file conceals practitioners' personal information. Public Citizen urged Congress to lift the veil of secrecy which is used to hide doctors who are frequently accused of medical malpractice, especially considering the small percentage of doctors responsible for the majority of the malpractice committed in the United States.  While 82% of doctors had not made a medical malpractice settlement payment since 1990, 5.9% of the others accounted for 57.8% of all medical malpractice payments since 1991.       <title>Medical Malpractice - Guiliani's Recent Comments</title>
      <description>&lt;p&gt;Recently at one of his rallies presidential candidate Rudy Guiliani was quoted as saying that her refers to attorneys that sue doctors as "the pig factor."  This is an interesting comment as it infers that all &lt;a href="http://www.citypaper.net/articles/2007/11/29/rudy-makes-the-rounds"&gt;malpractice&lt;/a&gt; lawsuits are without merit which cannot be further from the truth.  We all want to limit frivilous lawsuits however using propaganda against all lawyers is not the proper method as injured people must be able to have an avenue to recover for lost wages and medical expenses caused by the negligence of physicians.&lt;/p&gt;&lt;p&gt;As Mr. Guiliani was mayor of NYC I am suprised by his comments and he must simply be trying to be more appealing to the conservative base.  I say this because New York unlike numerous other states has safeguards in place to protect doctors from frivilous lawsuits.  In fact, I think if you do a web search of malpractice verdicts you would find that the ones that shock your conscience would be from other states.&lt;/p&gt;&lt;p&gt;We as a law firm only litigate those cases that have merit and prior to instituting a claim in New York a lawyer must get an opinion from a physician indicating that malpractice has occurred.       <title>Mdeical  Malpractice  Crisis???</title>
      <description>&lt;p&gt;As A lawyer directly involved in the medical malpractice debate I have personal experiences that reflect the true nature of the problem. Lawyers and lawsuits are not the cause of any so called medical malpractice crisis. In fact given the sorry state of the health care system in this country lawyers are the last and sometimes only line of defense for those who are  negligently and carelessly harmed by the healthcare system.&lt;/p&gt;&lt;p&gt;If patients harmed by medical negligence could not seek legal help who would help them? If a potential for a lawsuit did not exist who would regulate and supervise the healthcare system? Clearly the government cannot or will not regulate the rampant errors that plague our system. We spend more on healthcare than any other country yet what we get does not compare. It is not lawyers that cause bad healthcare. The number of claims reflects the state of the system. The governments answer to poor care to to regulate or ban lawsuits. Why? So the systems errors will not be brought.       <description>&lt;p&gt;It is easy to take one set of facts and say it applies to everyone. This tactic is used by those attacking the tort system on a regular basis. They use absurd or unusual cases to justify their demands for a change in the system. For example we can all agree that&lt;/p&gt;&lt;p&gt;Physicians are expected to evaluate their patients thoroughly and act in their best interest. Lawyers are expected, within reasonable limits, to investigate claims that their clients bring to them and file only lawsuits that have merit. This true fact was used in an article attacking medical malpractice lawsuits and by inference any type of personal injury claim. The problem is that it dealt with one lawyer in one situation.       <title>Medical Malpractice - Do you know anything about your doctor?</title>
      <description>&lt;p&gt;Attempting to find information on a physician can be difficult as the majority of the information is kept confidential by the various agencies.  Thus, even when a physician commits horrible acts in one State they sometimes can continue to practice in another.  Recently a physician in Minnesota, who was suspended years ago, was discovered practicing medicine and being paid by pharmaceutical companies to test drugs which involved trials with patients.&lt;/p&gt;&lt;p&gt;The article indicates that:&lt;/p&gt;&lt;p&gt;"Investigators are selected based on qualifications, training, research or clinical expertise in relevant fields." Yet Dr. Abuzzahab is far from the only doctor to have been disciplined or criticized by a medical board but later paid by drug makers.&lt;/p&gt;&lt;p&gt;An analysis of state records by The New York Times found more than 100 such doctors in Minnesota, at least two with criminal fraud convictions.
