Workers injured on construction sites have workers compensation to pay the lost wages and small portion of their wages (maximum of $400). However, these workers also have an alternate remedy pursuant to the New York Labor Law. Labor Law 240(1) protects workers who fell from a height or were struck by a falling object. Labor Law 241(6) protects workers pursuant to numerous regulations including but not limited to slippery surfaces, tripping hazards and unsecured ladders.

Recently, it was reported that a construction worker fell approximately 20 feet from a roof on Erie Blvd. This worker would likely be entitled to compensation from the owner of the building pursuant to Labor Law 240(1).
