Roofing Injuries - Workers Compensation/Labor Law

Few people are aware that when an injury occurs on a construction site their may be compensation available in addition to Workers Compensation benefits. In New York Labor Law 240(1), 241(6) and 200 have been enacted to protect workers in the event that they are injured while engaged in certain activities.

Recently, a roofer fell from a roof located on Erie Blvd. in Syracuse. This type of fall would likey be covered by labor Law 240(1) and that roofer would be entitled to collect workers compensation benefits as well as have a claim against the owner of the building for any additional lost wages as well as pain and suffering.

If you or someone you know has been injured while at work please do not hesitate to contact our office as we can answer any questions you may have regarding your rights.

For more information on this subject, please refer to the section on Worksite Injuries and Workers Compensation.

Originally posted at InjuryBoard by Rob Quattrocci

Construction Safety

Yesterdays roofer death shows how dangerous construction can be.<a href="A roofing contractor died this morning after losing his footing on a second-story roof and falling to a brick patio below."Accidents like this are all too frequent and demonstrate the need for construction safety laws. There has been considerable discussion about changing and eliminating many laws on the books to protect workers. Anyone involved in construction should actively insist worker safety laws are not changed. these laws protect injured workers on a construction project and allow them to sue over unsafe conditions.

For more information on this subject, please refer to the section on Worksite Injuries and Workers Compensation.

Originally posted at InjuryBoard by Joe Stanley

Construction Accidents - Roof - Syracuse

Workers injured on construction sites have workers compensation to pay the lost wages and small portion of their wages (maximum of $400). However, these workers also have an alternate remedy pursuant to the New York Labor Law. Labor Law 240(1) protects workers who fell from a height or were struck by a falling object. Labor Law 241(6) protects workers pursuant to numerous regulations including but not limited to slippery surfaces, tripping hazards and unsecured ladders.

Recently, it was reported that a construction worker fell approximately 20 feet from a roof on Erie Blvd. This worker would likely be entitled to compensation from the owner of the building pursuant to Labor Law 240(1).

For more information on this subject, please refer to the section on Worksite Injuries and Workers Compensation.

Originally posted at InjuryBoard by Rob Quattrocci

Construction Site Falls

As The weather worsens construction site become more dangerous. Ice ,water, mud, and snow can make work difficult. The owner of a work site must take reasonable precautions to make a job safe. If a dangerous condition exists make a record of your concerns. If you get hurt document the conditions and the cause of your fall. New York Law gives special protections to those hurt on a construction project. Even with the special protection it can be very difficult to bring a claim without proper proof.

For more information on this subject, please refer to the section on Worksite Injury and Workers Compensation.

Originally posted at InjuryBoard by Joe Stanley

Workers Compensation - Construction Accidents

If you have ever been injured during your employment you are aware of how frustrating Workers Compensation can be as it takes hearing after hearing to get anything accomplished. However, depending on the particular facts of your case, you may also have a personal injury claim against a responsible third-party. This arises most often in slip and falls where someone other than your employer is responsible for the maintenance of the building or parking lot and in construction accidents as special laws have been enacted to protect workers that place responsiblility on the owner/general contractor of the project. If you have any questions regarding these issues please do not hesitate to call our office.

For more information on this subject, please refer to the section on Workers Compensation.

Originally posted at InjuryBoard by Rob Quattrocci

Workers Compensation Reform

As I have discussed previously the law regarding workers compensation benefits in New York Has been changed significantly. In addition to the gradual elimination of lifetime benefits other important changes affecting every injured worker in all situations. It is more important for workers who are injured in car crashes construction sites or in any manner that is caused by someone other than his employer.

New rules have been put in place for all injured workers in the filing of claims. If you are an injured worker it is important to protect your rights and to investigate how and why your injury happened as soon as possible.

For more information on this subject matter, please refer to the section on Worksite Injuries and Workers Compensation.

For more information on this subject matter, please review our section on Workers Compensation.

Originally posted at InjuryBoard by Joe Stanley

Construction Injuries and Worker Protection

We have had several recent situations in which employees working on construction sites have had many difficulties after a worksite injury because of the classification of the employment situation. Employers are increasingly using the independent contractor claim to avoid legal responsibilities. So be careful when you are employed in any capacity. Contact a lawyer to help evaluate what your rights and obligations are if you are injured.

For more information on this subject matter, please refer to the section on Worksite Injuries and Workers Compensation.

Originally posted at InjuryBoard by Joe Stanley
